U.S.F.G., 962 P.2d 796 (Utah Supreme Court, 1998), a landmark case in the law of arbitration, which has been cited by over 100 treatises, learned journals and appellate cases, including International Arbitration Law and Practice, Domke on Commercial Arbitration, Arbitrage International: Droit et Pratique, Corbin on Contracts, and Couch on Insurance.
In the Jenkins case Mr. Bush and his firm helped set legal precedent when they forced an insurance company to keep its agreement. After USF&G broke its agreement to arbitrate, Mr. Bush sued the insurance company on behalf of his client. When the trial judge refused to enforce the agreement,
Bush Law Firm appealed to the Utah Supreme Court where the Justices agreed with Mr. Bush: The trial judge was in the wrong when he refused to enforce the agreement, they said, sending the case back to the trial judge so justice could be done. The case later settled during mediation for five times what had been offered before the appeal.
With the help of his wife's capable proofreading and editing skills, Mr. Bush has published over 50 articles in print and digital media on personal injury subjects, including:
